General terms and conditions
Scope
Metal Badge sells the goods offered online at metal-badge.ch, in catalogues and in advertisements to business and private customers (hereinafter “the customer”) under the following terms of delivery and contract (general terms and conditions). All mutual claims arising from or in connection with the conclusion of a contract between the customer and Metal Badge are governed by these general terms and conditions in the version valid at the time the respective contract is concluded. Should individual provisions of these general terms and conditions be invalid, the validity of the remaining provisions shall not be affected.
Conclusion of contract
The contract between the customer and Metal Badge is concluded when the customer places an order and Metal Badge accepts it. The customer may place an order verbally, by telephone, in writing by post, by fax, online or by email. Metal Badge accepts the order by sending the customer an order confirmation by fax, online, by email or by post, or by delivering the ordered goods.
Refusal of delivery
If the customer refuses to accept the ordered goods on delivery, Metal Badge reserves the right to block the customer from future orders without further notice and to charge the costs incurred (shipping, handling, refund fees, etc.).
Terms of payment
All prices on the website and in catalogues are indicative prices and may be adjusted to the market at any time. They are stated in Swiss francs (CHF) and include statutory VAT. In the online shop, the currency can be switched to euros (€). Prices are then displayed in euros at an exchange rate set by Metal Badge, and the order is charged in euros.
Shipping costs depend on the weight and the destination country. They are listed on the Shipping and payment page and are shown at checkout before the order is completed.
The available payment methods are also listed on the Shipping and payment page and at checkout. Payment by invoice is reserved for Swiss public authorities and companies with an order value of CHF 200 or more. Deliveries outside Switzerland are made exclusively against payment in advance. For payment in advance, the goods are shipped once payment has been received.
Metal Badge may insist on payment in advance without giving reasons. Default interest of 5% is charged on outstanding invoice amounts from the due date. Reminder and administrative fees are charged according to the actual effort and at customary market rates.
Terms of delivery
The ordered products are shipped to the countries listed in the online shop. The delivery time for stock items is usually 5–7 working days within Switzerland and 2–3 weeks outside Switzerland. Personalised products such as badges, Velcro labels or name tags require an additional production time of usually 2–3 weeks. All delivery times are estimates and are not binding. Express shipping is available on request for a surcharge.
For deliveries abroad, customs duties, import charges and VAT may apply. These are borne by the recipient.
Right of return
Within 10 days of receipt. Please contact us before returning any item. We will refund the full purchase price, excluding shipping costs, provided that the item is returned to Metal Badge in perfect condition and in its original packaging. Personalised products and products made to customer specifications (e.g. engravings, badges, Velcro labels and name tags, clothing with embroidery or logo printing) are excluded from the right of return.
Warranty
All goods are available only in the sizes and colours stated. Any colour differences between the illustrations and the item are due to technical reasons and do not constitute a defect. Minor irregularities are inherent in the nature of the material and therefore cannot be avoided by Metal Badge. These irregularities therefore do not constitute a defect. Any defects must be reported in writing within 10 days of receipt of the goods, or the item must be returned to Metal Badge with its packaging within 10 working days (see Right of return). The period begins on delivery of the goods and is deemed to have been met if the return is handed over to a post office no later than the 10th day after delivery. Claims for damages are entirely excluded.
Retention of title
The goods delivered remain the property of Metal Badge until paid for in full.
Data protection
All information collected is used exclusively to serve our customers better. Metal Badge respects your privacy, and your personal data is handled with the utmost care in accordance with data protection legislation. Details can be found in our privacy notice.
Place of performance
The place of performance for all services under the contract is Goldau, canton of Schwyz (Switzerland).
Changes to the terms and conditions
Metal Badge may amend these general terms and conditions at any time without prior notice. Please check this page regularly for any changes.
Place of jurisdiction and applicable law
All disputes arising from the business relationship between Metal Badge and the customer shall be decided exclusively by the ordinary court in Schwyz (Switzerland). Swiss law applies exclusively.
