General terms and conditions of Metal Badge

Metal Badge sells the offered products  appearing on the internet at metal-badge.ch in catalogues and in advertisments to business/private customers (hereinafter referred to as customer) under the listed terms and conditions. These general terms and conditions for all mutual claims out of context and in context of a contract concluded between the customer and Metal Badge apply to the version valid at the point in time of the conclusion of a respective contract.

In case  individual provisions of these general terms and conditions become invalid, the legal validity of the remaining provisions are not affected.

A contract between the customer and Metal Badge is entered into with an order of the customer and its acceptance by Metal Badge. The custom s order is to be placed verbally, by telephone, in written form by post, fax, via internet or by email. Metal Badge accepts the order by transmitting an order confirmation via fax, email, letter post, by internet or by delivery of the ordered items.

If the ordered items are not accepted at the time of delivery, Metal Badge reserves the right to block the customer s account for future orders without any further notice, as well as to apply charges for the costs incurred through shipment, processing, refund fees, etc.

All prices on the website as well as prices in catalogues are standard values which may be constantly adjusted to the market. They are in Swiss Franks (CHF) or in Euro, €. Metal Badge charges a blanket amount of at least CHF 10.- for shipments within Switzerland and CHF 16.- for EU countries. The following types of payment are applied within Switzerland: payment in advance, cash on delivery (plus cash on delivery fee) or payment on invoice. Shipments outside of Switzerland are exclusively processed by payment in advance, via Paypal, through bank or postcheque account or by cash on delivery. The payment can only be made in CHF or €. The shipment takes place after payment is received. The use of PayPal enables you to make payments securely via Internet. PayPal accepts all major credit cards. Metal Badge is entitled to demand payment in advance without giving reasons at any time. A default interest of 5% will be charged in case of outstanding invoices. Overdue costs and costs for expenditures will be charged as per costs incurred under current market terms.

Ordered products will be shipped within the countries listed in the webshop. The time of delivery for domestic shipments normally amounts to 14 days, outside of Switzerland from 3 up to 5 weeks. All statements regarding delivery periods are standard values and thus are not binding.

Within 10 days after receipt. We will refund the full purchase price, excluding shipping costs, provided that the object of purchase is in a faultless condition and is returned in its original packaging to Metal Badge.

All items are exclusively deliverable only in the given sizes and colours. Eventual colour differences between the illustrations and the article are technical and are not to be considered as an error. Minor irregularities are defined through the kind of material and thus cannot be avoided by Metal Badge. These irregularities therefore are not to be considered as deficiencies.  Detected defects are to indicated in written form within 10 days after receipt, respectively the article is to be returned with its original packaging within 10 work days to Metal Badge; see also point 5. The term of payment starts upon delivery of the product and is valid if the consignment is returned at the latest by the 10th day after delivery. Claims for damages are entirely out of the question.

The delivered items remain property of Metal Badge pending payment in full.

Metal Badge has the right to adjust the general terms and conditions at any time without any advance notice. Please check over this site at regular intervals for any possible alterations.

All disputes arising from the business relationship between Metal Badge and the customer will be exclusively judged by the court of law in Schwyz (Switzerland).  Swiss law is applicable exclusively.
